Please read these Terms of Service ("Terms") carefully before using goscout.ca. By creating an account or using the Platform, you agree to be bound by these Terms and our Privacy Policy.
1. About goScout
goScout ("goScout," "we," "us") operates goscout.ca, an online marketplace that connects customers seeking local services with independent service providers ("Providers"). goScout is a technology platform only. goScout is not a contractor, employer, staffing agency, or service provider. We do not perform services, supervise workers, or guarantee the quality of any work performed.
2. Eligibility
You must be at least 18 years old and legally capable of entering into a binding contract to use goScout. By using the Platform, you represent that you meet these requirements.
3. Account Registration
You agree to provide accurate, current, and complete information when registering, keep your account credentials confidential, notify us immediately of any unauthorized access to your account, and be responsible for all activity that occurs under your account. You may not create more than one account or impersonate another person.
4. goScout's Role as a Marketplace
goScout is a venue for connecting customers and providers. We do not employ or supervise Providers, guarantee the completion or quality of any service, verify that Providers hold valid licenses or insurance (information displayed is self-declared by Providers), mediate disputes between customers and Providers, or process payments between customers and Providers. All service agreements are made directly between the customer and the Provider. goScout is not a party to those agreements.
5. Provider Subscriptions
Providers pay $29 CAD/month to maintain an active profile on goScout. A 30-day free trial is offered to new Providers with no charge until the trial period ends. Subscriptions renew automatically each month until cancelled. Providers may cancel at any time via their dashboard or by emailing [email protected]. Cancellation takes effect at the end of the current billing period. No refunds are issued for partial months. If a payment fails, goScout will attempt to collect payment for up to 7 days before suspending the profile. goScout may change subscription pricing with at least 30 days written notice to existing subscribers.
6. Provider Responsibilities
By creating a provider profile, you agree to provide accurate information about your business and credentials, hold all licenses and insurance required to perform the services you advertise, respond to job requests in a timely manner, fulfil obligations made to customers, and not solicit customers to transact outside the goScout platform with the intent of avoiding goScout's fees.
7. Customer Responsibilities
By using goScout as a customer, you agree to provide accurate descriptions of service requests, show up or be available for agreed-upon appointments, pay providers directly for services as agreed, and submit reviews only for jobs you have genuinely experienced.
8. Reviews and Ratings
Reviews may only be submitted by customers who have completed a job through the goScout platform. Reviews must be honest and based on genuine experience. goScout reserves the right to remove reviews that violate our Review Policy. Providers may not offer incentives in exchange for reviews.
9. Prohibited Conduct
You may not use goScout to violate any applicable law or regulation, post false or deceptive content, harass or harm another user, scrape or distribute goScout's data without permission, circumvent goScout's systems or security measures, or use goScout for any purpose other than its intended use as a local services marketplace.
10. Intellectual Property
All goScout content, design, trademarks, logos, and software are owned by goScout Inc. You may not use goScout's brand assets without written permission. You retain ownership of content you submit and grant goScout a non-exclusive, royalty-free, worldwide licence to display and use that content to operate and promote the Platform.
11. Disclaimer of Warranties
THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. GOSCOUT DOES NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED OR ERROR-FREE.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, GOSCOUT'S LIABILITY TO YOU FOR ANY CLAIM ARISING FROM USE OF THE PLATFORM IS LIMITED TO THE AMOUNT YOU PAID TO GOSCOUT IN THE THREE MONTHS PRECEDING THE CLAIM, OR $100 CAD, WHICHEVER IS GREATER. GOSCOUT IS NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES. Nothing in these Terms limits liability for death or personal injury caused by negligence, or for fraud, as required by applicable law.
13. Indemnification
You agree to indemnify and hold harmless goScout Inc and its operators from any claims, losses, damages, and expenses (including reasonable legal fees) arising from your use of the Platform, your violation of these Terms, or your violation of any third-party rights.
14. Governing Law
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein. Any disputes shall be resolved in the courts of Ottawa, Ontario.
15. Dispute Resolution
Before initiating legal proceedings, we encourage you to contact us at [email protected] to resolve any dispute informally. We will make a good faith effort to resolve complaints within 14 business days.
16. Changes to Terms
goScout may update these Terms at any time. We will notify you by email and post notice on the Platform at least 14 days before material changes take effect. Continued use after the effective date constitutes acceptance.
